Abstract

The development of information technology and the widespread use of social media have transformed patterns of communication within society, including the way information and complaints regarding healthcare services are conveyed. Social media can serve as a platform for the public to report complaints concerning alleged malpractice in healthcare facilities. However, its use also raises legal issues related to transparency, accountability, personal data protection, and certainty in the handling of complaints. This study aims to analyze the legal regulations governing healthcare service supervision and the mechanisms for reporting alleged malpractice in Indonesia, as well as to examine the role of social media in supporting transparency and accountability in handling malpractice complaints in healthcare facilities. The research employs a normative legal research method using a statutory approach and a conceptual approach. The legal materials consist of primary legal materials, including laws and regulations relating to healthcare services, health professionals, consumer protection, electronic information and transactions, and personal data protection, as well as secondary legal materials in the form of books, scientific journals, and legal scholars' opinions. The results indicate that the supervision of healthcare services and the handling of alleged malpractice complaints have a legal basis through complaint and supervisory mechanisms implemented by the relevant authorities and healthcare facilities. Social media can serve as a supporting instrument for transparency by providing a platform for disseminating information, monitoring responses from healthcare facilities, and increasing public participation. However, its use must remain subject to applicable legal provisions, particularly those concerning the confidentiality of health information, personal data protection, patients' rights, the presumption of innocence, and the prohibition against disseminating information that may harm other parties. Therefore, social media can support transparency and accountability but cannot replace legally established mechanisms for reporting and resolving alleged malpractice
