PERLINDUNGAN HUKUM BAGI PEMEGANG SERTIPIKAT TANAH ELEKTRONIK

Peraturan Menteri Agraria dan Tata Ruang/Badan Pertanahan Nasional (Permen ATR/BPN) Nomor 3 Tahun 2023 tentang Penerbitan Dokumen Elektronik dalam Kegiatan Pendaftaran Tanah menandai era digitalisasi administrasi pertanahan di Indonesia. Artikel ini membahas perlindungan hukum bagi pemegang sertipikat tanah elektronik (Sertipikat-el) sebagai alat bukti hak yang sah. Penelitian ini menggunakan pendekatan normatif dengan analisis terhadap regulasi yang berlaku, khususnya dalam aspek keamanan, keabsahan, dan mitigasi risiko hukum bagi pemegang hak. Hasil kajian menunjukkan bahwa Sertipikat-el memiliki kekuatan hukum yang setara dengan sertipikat tanah fisik serta dilengkapi dengan sistem keamanan berbasis tanda tangan elektronik dan QR code. Namun, tantangan dalam penerapannya mencakup kesiapan infrastruktur, potensi ancaman siber, dan perlunya peningkatan literasi hukum masyarakat.
